Terms of Service

These Terms govern your use of Pay | The Creator. By creating an account or accessing a review link, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. Who we are

Pay | The Creator (“Pay | The Creator”, “we”, “us”, “our”) is operated by Bluecelestials (Pty) Ltd, a company registered in the Republic of South Africa.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use Pay | The Creator. By creating an account you represent that you meet these requirements.

3. Account terms

  • You are responsible for keeping your account credentials secure and for all activity that occurs under your account.
  • You must provide accurate and complete information during sign-up and keep it current.
  • You agree not to share your account with another person or to allow another person to use your credentials.

4. Subscription and billing

Access to Pay | The Creator requires an active monthly subscription billed in South African Rand via Payfast (Pty) Ltd. By starting a subscription you authorise Payfast to charge your payment method on a recurring basis until you cancel.

  • Cancellation. You may cancel your subscription at any time through your Payfast account. Cancellation takes effect at the end of the current billing period; we do not provide pro-rated refunds for partial months.
  • Failed payments. If a recurring payment fails, your access to upload, deliver, or unlock drops may be suspended until billing is restored.
  • Price changes. We may change subscription pricing with at least 30 days' advance notice by email; continued use after the effective date constitutes acceptance.

5. The creator–brand relationship

Pay | The Creator is a secure file delivery platform. We do not process direct invoices between parties and hold no liability for content licensing, copyright disputes, or payment agreements between the Creator and the Brand. The decision to lock or unlock a drop is made entirely by the Creator and is not verified by us.

You acknowledge that:

  • Any commercial arrangement (fee, licence scope, usage rights, exclusivity, etc.) between a Creator and a Brand is a private contract between them.
  • We are not a party to that contract and assume no obligation to mediate or enforce it.
  • A drop being “Unlocked” in Pay | The Creator is not confirmation that payment has cleared, is sufficient, or matches any underlying agreement.

6. UGC Content Guidelines

You must only upload content that you have the right to upload and that you have the right to share with the Brand to whom you assign the drop. You must not upload content that:

  • Infringes any third party's copyright, trademark, right of publicity, or any other intellectual-property right.
  • Contains material that is defamatory, harassing, threatening, or discriminatory on the basis of any protected characteristic.
  • Depicts a minor in a sexualised context, contains child sexual abuse material (CSAM), or otherwise violates the Films and Publications Act, 1996 of South Africa or any equivalent law in your jurisdiction.
  • Contains non-consensual intimate imagery, doxxing, or material that poses a credible threat of harm.
  • Includes malware, deceptive identifiers, or attempts to circumvent security features of the service.
  • Violates any applicable law, including the General Data Protection Regulation (where applicable), POPIA, or any export-control law.

We may remove content, suspend accounts, and (where required by law) report content or activity to the relevant authorities at our sole discretion.

7. Acceptable use

You agree not to:

  • Reverse-engineer, decompile, or attempt to extract source code from the service.
  • Probe, scan, or test the vulnerability of any system without our prior written consent.
  • Use the service to send unsolicited bulk communication or to circumvent rate limits.
  • Resell, sublicense, or operate the service on behalf of a third party as a managed service without a separate written agreement with us.

8. Intellectual property

Your content. You retain all ownership rights in the videos, logos, brand records, and other content you upload. By using the service, you grant Pay | The Creator a worldwide, non-exclusive, royalty-free licence to host, transmit, transcode (including the generation of watermarked previews), and display your content solely for the purpose of operating the service for you and the Brands you designate. This licence ends when you delete the content or your account, except to the extent backups must persist for the retention periods set out in our Privacy Policy.

Our content. The Pay | The Creator name, logo, and software are our intellectual property. Nothing in these Terms grants you any right to use our brand without our prior written consent.

9. DMCA / Copyright takedown

If you believe in good faith that content hosted on Pay | The Creator infringes your copyright, you may submit a takedown notice to admin@bluerockets.co.za with the following information, as required by 17 U.S.C. § 512(c)(3) of the United States Digital Millennium Copyright Act:

  • Your physical or electronic signature, name, address, and contact details.
  • Identification of the copyrighted work claimed to have been infringed.
  • The URL of the allegedly infringing material (e.g. the review link), sufficient to enable us to locate it.
  • A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information is accurate and that you are authorised to act on behalf of the owner of the right that is allegedly infringed.

We will respond to valid notices, remove or disable access to the material, and notify the Creator concerned. Creators may submit a counter-notice as provided for in 17 U.S.C. § 512(g). Repeat infringers will have their accounts terminated.

10. Termination

You may terminate your account at any time from Settings or by emailing admin@bluerockets.co.za. We may suspend or terminate your account if you materially breach these Terms or if required by law. Termination does not entitle you to a refund for the current billing period.

11. Disclaimer and limitation of liability

The service is provided “as is” and “as available”, without warranties of any kind, whether express or implied. To the maximum extent permitted by law, Pay | The Creator's total aggregate liability arising out of or relating to these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim. In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profit, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

12. Indemnity

You agree to indemnify and hold harmless Pay | The Creator, its officers, directors, employees, and agents from any claim or demand, including reasonable legal fees, arising out of your use of the service, your content, or your breach of these Terms.

13. Governing law and dispute resolution

These Terms are governed by the law of the Republic of South Africa. The parties consent to the exclusive jurisdiction of the High Court of South Africa, [Gauteng Local Division, Johannesburg], in respect of any dispute arising out of or in connection with these Terms, subject to either party's right to seek urgent interim relief in any competent court.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email and update the “Last updated” date above. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
